Terms and Conditions
Terms of use for the WayVenture platform.
1. Scope
These General Terms and Conditions ("Terms") apply to all business relationships between Christian Dechant (hereinafter: "Provider") and the users of the WayVenture platform (hereinafter: "User").
Deviating, conflicting or supplementary terms and conditions of the User only become part of the contract if and to the extent that the Provider has expressly agreed to their validity.
2. Description of services
WayVenture is a web application for planning trips, managing travel budgets and documenting journeys. The Provider makes storage space and features available to the User for recording, managing and sharing travel data with others.
3. Registration and conclusion of contract
Registration is required to use the platform. The User is obliged to provide the data requested during registration truthfully and completely.
By submitting the registration form, the User makes an offer to conclude a contract of use. The contract is concluded when the Provider activates the account. The contract language is German.
4. Fees and payment terms
Basic use of the platform (Free plan) is free of charge. The following paid subscriptions are available for extended features:
- Weltenbummler – €4.99/month
- Globetrotter – €9.99/month
- Creator – €14.99/month
Payments are processed via the payment service providers offered during checkout. All prices include the statutory value added tax applicable at the time.
5. Term and termination
Paid subscriptions are billed monthly and renew automatically for a further month unless cancelled in time.
The User can cancel their subscription at any time with effect from the end of the current billing period. Cancellation is possible in the account settings of the platform or by email to the Provider. After cancellation, access to the booked features remains available until the end of the paid period.
After a subscription has expired, the User's data is retained for 30 days and then irrevocably deleted, unless the User has made a backup. The Free plan remains available without data loss.
The right to extraordinary termination for good cause remains unaffected.
6. Right of withdrawal
Information on the right of withdrawal
As a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Christian Dechant, email: support@wayventure.app) of your decision to withdraw from this contract by means of a clear statement (e.g. an email).
To meet the withdrawal deadline, it is sufficient that you send your notice of exercising the right of withdrawal before the withdrawal period has expired.
Expiry of the right of withdrawal
For a contract on the supply of digital content, the right of withdrawal expires early if the Provider has begun performing the contract after the User has expressly agreed that the Provider may begin performance before the withdrawal period expires, and the User has confirmed their awareness that they lose their right of withdrawal by giving this consent.
By booking a paid subscription and confirming immediate access to the digital content, the User expressly agrees that the right of withdrawal expires as soon as performance of the contract begins.
Consequences of withdrawal
If the right of withdrawal has not expired due to the consent described above and you withdraw from this contract, we will refund all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction.
7. Obligations of the User
The User is solely responsible for the content they upload (texts, images, data). They ensure that this content does not violate applicable law or the rights of third parties (in particular copyrights and trademark rights).
It is prohibited to use the platform for unlawful purposes or to distribute malware.
8. Liability
The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is only liable for the breach of an essential contractual obligation (cardinal obligation), in which case liability is limited to the typically foreseeable damage.
The Provider does not guarantee the constant availability of the platform or the accuracy of data provided by users or third parties.
9. Data protection
Personal data is processed in accordance with our privacy policy.
10. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, the place of performance and jurisdiction is the Provider's registered place of business.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
